Job OverviewContent Responsibilities • Be responsible for supporting the day-to-day handling of trademark and copyright matters, including portfolio management and execution of the global brand strategy for the assigned business segments, with the goal of achieving required MP related business results for each • Provides support to the MP-AGCs to ensure execution of global and related regional/local market appropriate business segment strategies • Collaborates with the Senior Specialists and/or Paralegals to ensure global and regional/local market appropriate strategies are executed • Works closely with Senior Specialist-Global Systems & Docketing to ensure all related docketing and filing standard operating procedures are supportive of MP practice area needs and ensures proper data and filing documentation is transferred to the Systems & Docketing team • Provides support and/or handles directly and/or assigns to local country counsels, and then manages: trademark clearance, prosecution, oppositions and cancellations, copyright registration, domain name portfolio management, intra-company licensing support, day-to-day counseling, and enforcement disputes including cease and desist letters, litigation, anti-counterfeiting and settlements for the assigned segments • Participates in and oversees local country counsels for the assigned segments • Uses best practices and knowledge of internal and external business issues to deliver on strategies for assigned segments • Understands the business, and understands how the trademark department integrates with other cross-functional partners to achieve objectives for the assigned segments • Supports Commercial Legal in trademark related matters Senior Counsel is a trusted and proactive advisor to internal business clients, providing clear communication of business risks, potential mitigation of risk, and solution oriented options to minimize risks. Senior Counsel advises as a business partner with an expertise in trademark law. • Ensures and adheres to solid standard operating procedures and other existing processes and assists MP AGCs in optimizing same • Assists with MP education and conducts training sessions for the assigned segment • Actively manages and motivates team members, creating a culture of engagement and development, and builds an impactful team environment. Develops and educates other members of the team with less experience. • Assists with overall invoice review for assigned business segments • Actively participates in professional trade organizations, associations and/or regulatory commissions for personal development and as aligned with Mars policy and as agreed by MP-AGCs Key Experience • A graduate of an accredited law school and professionally qualified lawyer with 8 to 15 years of experience, including both in a law firm and in an in-house role and demonstrated success in trademark practice with strong brand strategy business acumen • Active legal practitioner able to handle clearance and prosecution and enforcement matters directly in country where qualified/admitted, as well as oversee related global or multi-national portfolio issues Expertise in: • Working with team members to implement the strategic direction of business to meet business goals through clearance and prosecution and enforcement practices • With regard to clearance and prosecution, in particular: preparing clearance reports in country where trained, reviewing and summarizing clearance reports from local country outside counsels, reviewing office actions and related responses, commenting on both and discussing with knowledge, internally and with local country outside counsels, to formulate response strategy • With regard to enforcement, in particular: watch notice review and analysis, preparing opinions, and requests for and review of local country outside counsel opinions, regarding likelihood of success for possible opposition or cancellation actions and disputes, including cease and desist matters, oversight of local counsels work on enforcement matters including, gathering third party and business segment evidence to support enforcement efforts, conducting research, reviewing investigation reports and analyzing same, initial drafting of pro-forma disputes letters, including warning and cease and desist letters or responses thereto, initial review of same as prepared by local country outside counsel, and preparing and/or reviewing affidavits/declarations Experience with: • Trade dress, packaging and advertising issues • Domain name portfolio maintenance • Global intra-company licensing program • Brand-related aspects f online presence (mobile, digital and social media issues) • Anti-counterfeiting Ability in: • Working collaboratively with team members servicing major global businesses and providing strategic legal advice and guidance with regard to brand development, growth and protection strategies • Customer/client focused approach to working with business • Managing relatinships with sensitivity and flexibility between an internal MP team, business professionals and local country outside counsels • Managing wrkload priorities to ensure deadlines are managed and responses provided in a timely manner • Quickly priritizing and focusing efforts upon the most critical issues and engaging fully with MP team to implement same • Trademark databases and legal billing sftware such as WebTMS and Serengeti, respectively, as well as PowerPoint and Excel
